These Terms of Service govern your use of Koala Sleep. By using the app, you agree to these terms and to our Privacy Policy.
1. The service
Koala Sleep provides sleep sounds, white noise, ambient audio, timers, playlists, saved mixes, account sync, and optional membership features. Features may vary by platform, region, app version, or membership status.
2. Eligibility
You must be at least 13 years old to use Koala Sleep. If you are under the age of majority in your jurisdiction, you may use the app only with permission from a parent or legal guardian.
3. Accounts
Some features require an account or third-party sign-in. You are responsible for maintaining the confidentiality of your account credentials and for activities that occur under your account. Please contact us if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Use the app for unlawful, harmful, abusive, or fraudulent purposes.
- Attempt to bypass membership limits, security controls, or purchase verification.
- Reverse engineer, copy, scrape, or redistribute the app or its audio content except as permitted by law.
- Interfere with servers, networks, accounts, or other users' access to the service.
- Upload or sync content that infringes rights or violates applicable law.
5. Health and wellness disclaimer
Koala Sleep is intended for relaxation, sleep routines, focus, and ambient listening. It is not a medical device and does not provide medical advice, diagnosis, treatment, therapy, or emergency support. Consult a qualified professional for medical or mental health concerns.
6. Memberships and purchases
Koala Sleep may offer paid memberships, subscriptions, or in-app purchases. Prices, billing periods, trial terms, renewal rules, cancellation methods, and refunds are controlled by the app store or payment platform used for the purchase, unless otherwise stated. You can manage or cancel app-store subscriptions through your app-store account.
7. Content and intellectual property
The app, design, software, logos, text, audio collections, and related materials are owned by Sovo Studio or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the app for your own lawful purposes.
8. User data and synced content
You may create playlists, favorites, saved mixes, and settings. You retain your rights in information you provide, but you grant us permission to host, process, and sync it as needed to operate the service. We may remove content or restrict access if required by law or if it violates these terms.
9. Third-party services
The app may rely on third-party services such as app stores, Google Sign-In, purchase verification providers, and cloud hosting providers. Your use of those services may be subject to their own terms and policies.
10. Changes and availability
We may add, change, suspend, or discontinue features, content, prices, or availability. We try to keep the service reliable, but we do not guarantee uninterrupted, error-free, or permanently available access.
11. Termination
You may stop using Koala Sleep at any time. We may suspend or terminate access if you violate these terms, create risk or legal exposure, misuse the service, or if continued operation is not commercially or technically feasible.
12. Disclaimer of warranties
Koala Sleep is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
13. Limitation of liability
To the maximum extent permitted by law, Sovo Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or service interruption arising from or related to your use of Koala Sleep.
14. Governing law
These terms are governed by applicable laws, without regard to conflict-of-law rules. Mandatory consumer protection rights in your place of residence are not limited by these terms.
15. Updates to these terms
We may update these Terms of Service from time to time. If changes are material, we will provide reasonable notice where appropriate. Continued use of the app after changes become effective means you accept the updated terms.
